Terms of Use

These terms apply to your use of Flipilo at flipilo.com (the "Service"), provided by Michu Ltd. Şti. ("we", "us"). Flipilo is operated by Michu Ltd. Şti. (full legal name: MICHU YİYECEK İÇECEK GIDA HİZMETLERİ SANAYİ VE TİCARET LİMİTED ŞİRKETİ), a company registered in Türkiye, with its address at İkitelli OSB, Başakşehir, 34490 Istanbul, Türkiye. By using the Service you agree to these terms. If you do not agree, please do not use the Service.

1. What Flipilo does

Flipilo monitors used cars advertised for sale in the UK on third party marketplaces, compares each car with similar cars, and shows you cars whose asking price looks low compared with the market. It can notify you when a new car matches your alerts. Flipilo does not sell cars, is not a party to any purchase, and never sits between you and a seller. Flipilo is not affiliated with or endorsed by AutoTrader or any other marketplace.

2. Closed beta and accounts

The Service is currently a closed beta. Access is by invitation: you can request access, and we decide whether to approve it. Accounts are created by us and are personal to you. You must keep your username and PIN confidential, must not share your account with anyone else, and must tell us promptly at [email protected] if you think someone else has used it. As a beta, features may change, be limited or be withdrawn, and the Service may be unavailable at times.

You must be at least 18 to use the Service.

3. Information only, not advice

• Market prices, private prices, dealer prices, discounts and potential margins are statistical estimates based on comparable adverts. They can be wrong.
• The "dealer buy" price is a simple rule of thumb estimate of what a dealer might pay. It is not an offer and not a quote from any dealer.
• Our filters for damage, write-off categories, modifications, imports and similar issues rely on what sellers write and are not complete.
• Before buying any car you should see it in person, check its condition, check its identity and documents, and carry out your own history check (for example an HPI or similar check for outstanding finance, write-off and theft records) and an MOT history check.
• You alone decide whether to buy, what to pay and whether to resell. Any profit or loss is yours.

4. Third party data

Car details, prices, photos and descriptions come from adverts published by sellers on third party marketplaces. We do not create or check this content and cannot guarantee that it is accurate, complete or up to date. A car may already be sold when you see it. Links to third party sites are provided for convenience; their own terms apply there.

5. Acceptable use

You must not:

• share your account, or let anyone else use the Service through it;
• copy, scrape, download in bulk, resell, republish or redistribute data from the Service, or use it to build a competing product;
• use automated tools to access the Service, or try to get around access limits or security;
• use the Service to harass sellers, or for anything unlawful;
• interfere with the Service or its infrastructure.

6. Our content

The Service, including its software, design, price estimates and analysis, belongs to us or our licensors. We give you a personal, non transferable, revocable licence to use it for your own car buying while your account is active.

7. Payment

The Service is currently free during the beta. We plan to offer paid plans in future. Paid plans will be sold through a payment provider, and the price, billing and cancellation terms will be shown to you before you agree to pay. You will not be charged unless you choose to subscribe.

8. Suspension and ending your account

You can stop using the Service and ask us to close your account at any time by emailing [email protected]. We may suspend or close your account if you break these terms, if we reasonably suspect misuse, or if we end the beta or the Service. Where reasonable we will give you notice first.

9. Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under English law. If you use the Service as a consumer, you also have legal rights that these terms do not affect.

Subject to that:

• the Service is provided during the beta on an "as is" and "as available" basis, and we do not promise that it will be uninterrupted, error free, or that any car shown is a good deal;
• we are not responsible for any decision you make to buy, not buy, price or resell a vehicle, for the condition, history or legal status of any vehicle, or for anything a seller or third party does;
• if you use the Service for business purposes (for example as a trader or dealer), we are not liable to you for loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss;
• our total liability to you arising from the Service in any 12 month period is limited to the greater of the fees you paid us in that period and £100.

If you are a consumer, we are only responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

11. Changes to these terms

We may update these terms, for example when paid plans launch or the law changes. We will update the date at the top and, for material changes, tell you in the app or by email before they take effect. If you keep using the Service after that, the new terms apply. If you do not agree, you can close your account.

12. General

If any part of these terms is found unenforceable, the rest remains in force. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
